Law Minister Calls for Quality Legal Services to be Reached to the Poor

Union Law & Justice Minister Shri D.V. Sadananda Gowda has called for appropriate and effective legal services to be reached to poor, to ensure equality before law as we are a welfare state. Addressing an orientation workshop cum launching function organized by the National Legal Services Authority (NALSA) in collaboration with the Delhi State Legal Authority (DLSA) in New Delhi , he said the legal services programme must be region specific to consider all local factors. The Minister said that Legal Aid Services is one of the essential functions of a Welfare State for a simple reason that in a welfare state people should have equal access to justice irrespective of the constraints as well as differences in socio-economic backgrounds. He said continuous evaluation and revision of ongoing programmes is also necessary to remove major hurdles in accessing justice and there is a need for incorporation of specific legal services provision in these schemes. He said it should be assessed to see as to how many cases are those involving a requirement of legal aid among 26 crore cases that in pendency.

In his key note address Shri T.S. Thakur, Judge, Supreme Court of India emphasized the need to create awareness about the Legal Aid Services Programmes especially in the younger generation. He said to ensure the mission of NALSA “Access of Justice to all “, we will have to approach people for this purpose. He said, NALSA through its state level bodies makes recommendations for revamping and proper implementation of schemes.

The other speakers on the occasion were Judge of the Supreme Court Shri Anil R.Dave, Justice Ms. G.Rohini, Chief Justice of Delhi High Court and Judge of Delhi High Court Shri B.D.Ahmad.

On this occasion, the following seven (07) new and revised schemes were also launched. These are to be implemented by the Legal Services Institutions at the National, State, District and Taluk Levels

1. NALSA (Victims of trafficking and Commercial Sexual Exploitation) Scheme, 2015

2. NALSA (Legal Services to the Workers in the Unorganised Sector) Scheme, 2015

3. NALSA (Child Friendly Legal Services to Children and their Protection) Scheme, 2015

4. NALSA (Legal Services to the Mentally Ill and Mentally Disabled Persons) Scheme, 2015

5. NALSA (Effective Implementation of Poverty Alleviation Schemes) Scheme,2015

6. NALSA (Protection and Enforcement of Tribal Rights) Scheme, 2015

7. NALSA (Legal Services to the Victims of Drug Abuse and Eradication of Drug Menace) Scheme, 2015.

The Legal Services Authorities Act, 1987 has created Legal Services Institutions at the National, State, District and Taluk Levels to provide Legal Services to the marginalized sections of the society in order to ensure that they are able to avail their rights and entitlements. Apart from providing court related services, the Legal Services Institutions are also mandated to undertake awareness programmes and preventive and strategic legal aid programmes. NALSA being the Central Authority is required to advice on framing of effective and meaningful schemes for making Legal Services accessible under the Act. The Minister further added that for this purpose the present actualization workshop has been convened in collaboration with the Delhi State Legal services Authority, in which after the presentations by Judges, the Secretaries of the concerned Departments will give an overview of the Government policies, scheme and facilities for the target groups. In the open house discussions in each session, further suggestions for effective implementation of the schemes will be invited from the participants.

The government of Rajasthan, Department of Information Technology & Communication has revised its Rajasthan eGovernance and IT/ITeS Policy 2015. The policy was released in 2007, which aimed at leveraging Information Technology for implementing eGovernance initiatives benefitting the residents.

The government released the new set of policies keeping in mind the changes in economic and regulatory frameworks. It emphasises on development of public, government departments and promotion of IT/ITeS/ESDM/Robotics sector.

The objectives of the policy include providing Information Technology for good governance, promotion of economic development of State by enhanced investment in IT/ITeS/ESDM/Robotics Sector, IT related human capital development and establishing secure and green IT environment in Rajasthan.

Despite rate cut, real estate sentiments lukewarm this festive season: Assocham

Despite the recent rate cut of 50 bps by Reserve Bank of India (RBI) and great offers made by developers on the festive season, the investment in the property have remained lukewarm in and around the NCR region due to lack of confidence in state of economy, delay in project execution, lack of fresh employment generation and overall slowdown, reveals the ASSOCHAM recent study.

“The sentiment in the housing market is really at a low key. The prices have almost crashed but they are still un-affordable. Be it Rohini, Dwarka, South Delhi, Noida, Gurgaon, the prices of property are down by 25-30% as compared to the last two years.”, said Mr. D S Rawat, Secretary General ASSOCHAM while releasing the survey.

The ASSOCHAM conducted a random survey of nearly 125 real estate developers in Delhi-NCR. The survey reveals that demand for buying property have decreased by over 30% over the last year.

As per the ASSOCHAM paper, inordinate delays in getting necessary approvals from multiple regulations and authorities result in cost and times overruns. The resale or secondary market is also dull this festival season as there is very little resale going especially in the NCR and surrounding areas, adds the survey.

According to survey, the residential market has witnessed a steep decline by 25-30% in new launches as well as demand resulting a significant shrinkage. The unsold inventory pressure in NCR region is the highest among all other cities.

According to the majority of real estate developers in NCR regions said, about 62% of the unsold real estate in NCR is in areas which are currently uninhabitable. The problem has been confounded by delays in regulatory clearances and litigations, points out the survey.

The NCR residential market still has an estimated 1,70,000 units of unsold inventory which is approximately 30% of the units under construction, adds the survey. As per the survey, there are nearly 8.5 million workers engaged in building and other construction activities in India.

The ticket price 3-bedroom, 2 BHK  and single room flats has seen correction by 30 per cent in Noida, 25 per cent in Gurgaon and 15 per cent in some key areas of Delhi but still, the demand stays subdued, adds the survey.

Modular kitchen, LED televisions and air conditioners are among the most common freebies on offer this Diwali. Some developers offered hefty discounts to the basic sale price for early investors. Many others warned of sharp revision in property rates post Diwali. However, the lure of freebies failed to charm home buyers, the survey noted.

Majority of the developers have complained that inordinate delays in getting necessary approvals from multiple regulations and authorities resulted in cost and time overruns.

To counter the slump in sales, developers have been offering some discounts and incentives. But even these steps have failed to attract buyers. The sales continued to remain low despite developers offering attractive pricing schemes and discounts to attract buyers.

Festive season considered to be auspicious for home buying and offering bargains, contributes over 30 percent of annual realty sales. But with the prevailing depressed market sentiment, the sector has been witnessing muted sales since the festive season of 2015, recording 30-35 percent lower sales compared to the healthy period of 2010-11.

Besides offering standard freebies like parking and club facilities, modular kitchens, air-conditioners, developers are taking just 5-10 percent of the house price as booking amount and that too in installments, with the balance payment on possession.

US AMBASSADOR SEEKS RELAXATION IN INDIA’S REGULATORY FRAMEWORK ON HIGHER EDUCATION

United States Ambassador to India Mr. Richard Rahul Verma on Friday asked India to release its regulatory grip over its higher education system to enable leading universities and institutes of academic excellence in US and other part of the globe to open up their campuses here to cement Indo-US partnership in the field of higher education.

Addressing a Panel Discussion on ‘Reimaging the Future’ organized here today under aegis of PHD Chamber of Commerce and Industry, the Ambassador said, “regulatory regime in India, particularly in its higher education system is stiffer and firmer that has halted institutions of academic excellence to set up their campuses in India even though India and US have closely been cooperating in the areas of space, defence, research, agriculture and ocean sciences”.

“What is needed as also called for are successive attempts on the part of the Indian government so that its regulatory grip over its higher education system is released earlier than anticipated to make sure that leading universities are able to expand in countries like India so that the partnership is further intensified and multiplied and the quality of education undergoes a massive transformation”, he said.

The alluded issue is very much in the knowledge of the Prime Minister Mr. Modi and US administration is hopeful that the referred grip would gradually snip away and the two largest democracies of the world begin to cooperate in the field of higher education also as India is the second largest country in the world whose students immigrate towards US for attainment of higher education, pointed out Ambassador Verma.

Presiding over the Panel Discussion, Purdue University President and Former Governor of Indiana, Mr. Mitch Daniels said that ethics should be made one of the subjects mandatory in the syllabi of management education in India.

In his welcome remarks, President, PHD Chamber, Mr. Alok B. Shriram suggested that the evolving education system in general and that of higher education in particular need to grow and get diversified to serve the emerging needs of the modern businesses with an element of practicality in it.

Thales wins French Navy simulator support contract

Thales has been chosen by the French Navy to provide through-life support (TLS) for almost all of its simulators. The six-year contract with the Navy’s fleet support department (SSF) calls for the support of 41 simulators at six naval facilities in France. These simulators cover a broad spectrum of operations and all deployment contexts, from shipboard system maintenance to surface vessel crew training as well as firing simulators for the Mistral missile, 12.7 mm and 20 mm guns and other weapons. They are used to train the crews of all French Navy surface vessels, including its multimission frigates, air defence frigates and the Charles de Gaulle aircraft carrier.Thales wins French Navy simulator support-indianbureaucracy

The new TLS contract covers simulators delivered from the 1990s to today, including systems currently on order. This latest award strengthens Thales’s leadership in training and simulation for naval customers.

Government Sets a Target of 90 Per Cent OTP for Air India

Concerned over its on-time performance (OTP), Government has asked Air India to achieve higher efficiency in its operations and set a target of 90 per cent OTP for this month.

The state-owned carrier had delivered an OTP of 82.4 per cent in September, and stood just one-notch above the start-up regional carrier Air Paegasus, among the nine domestic airlines, in the ranking.

The target was set during a recent review meeting of the airline, which was chaired by Civil Aviation Ashok Gajapathi Raju, sources said.

“Though Air India has improved its OTP quite considerably in the last few months, Ministry feels that it needs to boost this further, more so when most of the other domestic carriers are clocking over 85 per cent,” sources said.

According to the DGCA OTP data for September, the two other full service carriers –Jet Airways and Vistara — reported  87.4 and 94.2 per cent OTP respectively during the month.

Budget airlines IndiGo and SpiceJet flights took and landed on 92.4 per cent and 95.1 per cent on the scheduled time respectively.

The Aviation Ministry has asked Air India to make sure that at least 90 per cent of its flights, if not more, depart and land on time across airports in the current month, they said.

Pointing out that Air India is a network carrier and not a point-to-point carrier, sources said that Air India has done better in terms of OTP in the last month compared to previous month.

“Air India’s OTP is certainly better in October as against September. However, considering that Air India is a network carrier in the sense that it has more connecting flight than direct flights unlike some point-to-point carriers (who fly direct more), aircraft turnaround time also go up, which also impact OTP significantly,” sources said.

Significantly, airline is also laggard in average OTP from four metros –Delhi, Mumbai, Bengaluru and Hyderabad.

As against an average 91.5 per cent OTP delivered by IndiGo and 89 per cent by Jet Airways from these four airports in September, Air India’s average OTP stood only at 81.9 per cent during the period.

First copy of ‘The President of India & the Governance of Higher Education Institutions’ presented to the President

The President of India, Shri Pranab Mukherjee received the first copy of a book ‘The President of India and the Governance of Higher Education Institutions’ at Rashtrapati Bhavan from the Founding Chancellor Mr. Naveen Jindal and Founding Vice Chancellor, Professor (Dr.) C. Raj Kumar of O.P. Jindal Global University.

Speaking on the occasion,the President underlined the need to focus on improving the quality of teaching, faculty and research in our Universities. The President said that in his capacity as Visitor of Central Institutions of higher learning he has been repeatedly stressing on the need to have quality education and that Universities should take the ranking process seriously. He said it is not that our country lacks the requisite talent or merit. Concerted efforts over the past few years have shown some good results and recently, two Indian institutions found a place among the top 200 universities as per an international ranking. He was hopeful of other institutes improving their ranks in the future.

The President congratulated the authors and the O.P. Jindal Global University as well as the International Institute for Higher Education Research & Capacity Building for bringing out the book.

‘Religion-neutral’ national population policy needed, says RSS

The government should lay out a religious-neutral national population policy to check the “demographic imbalance”, the Rashtriya Swayamsevak Sangh said, reported by PTI. To correct this imbalance, “persuasion through education” and creating awareness would be the key steps, the organisation said. The RSS has been increasingly concerned about the growing Muslim and Christian populations in the country, with the population of Hindus declining below 80% for the first time, which it thinks is a troubling change in proportions.

RSS Delhi’s co-incharge Alok Kumar said, “We found quotations from the Quran, where it has been stated that if you are unable to rear your family, its size should be kept small. We think that is sage advice and should be followed by every section of society.”

The organisation also said that they are in favour of the current reservation policy for the underprivileged, but it should not be based on religion as that would be against the spirit of the Constitution.
