State Governments are empowered, under Section 23C of the Mines and Minerals (Development and Regulation) Act, 1957 (MMDR Act, 1957) to make rules for prevention of illegal mining, transportation and storage of minerals; and, therefore, matters relating to illegal mining come under the legislative and administrative jurisdiction of State Governments.

However, based on the quarterly returns on illegal mining submitted by various State Governments to Indian Bureau of Mines (IBM) (a subordinate office under the Ministry of Mines), state-wise details of instances of illegal mining reported in various parts of the country for last three years along with the details of action taken by the State Governments thereon including details of realization of fines .

However, IBM has procured thirteen satellite imageries from National Remote Sensing Centre, Indian Space Research Organization (ISRO), Hyderabad at a cost of Rs.1,08,000/- for identification of mining excavations towards formulation of mineral development plans pertaining to Adityana & Bhakharala villages in Porbandar district of Gujarat.

The Ministry of Mines has constituted a ‘Central Coordination-cum-Empowered Committee (CCEC)’ under the Chairmanship of Secretary (Mines) with members which include the Central Ministries/Departments of Environment and Forests & Climate Change, Home Affairs, Steel, Civil Aviation, Railways, Shipping, Revenue, Fertilizers, Atomic Energy; twelve important mineral producing States of Andhra Pradesh, Chhattisgarh, Goa, Gujarat, Jharkhand, Karnataka, Madhya Pradesh, Maharashtra, Orissa, Rajasthan, Tamil Nadu, Telangana; and the Indian Bureau of Mines, and Geological Survey of India (subordinate offices of the Ministry of Mines).

The CCEC holds quarterly meetings to consider and review all mining related issues, including matters relating to illegal mining and the steps being taken by the State Governments in detecting and preventing illegal mining.
